Welcome to our website. At Bloomtrigger we aim to provide you with simple, affordable and creative ways to protect forests. We enable you to invest in the protection of forests through the purchasing of our ‘bloom’ credits. We will only invest your money in conservation projects that meet the highest standards. Our aim is perpetual forest preservation and we are committed to a 40 year preservation model as a minimum.

By using this website you agree to comply with and be bound by the following terms of use (the "Terms of Use"), which together with our privacy policy govern Bloomtrigger CIC's relationship with you in relation to this website. The term " Bloomtrigger CIC", "Bloomtrigger" or "us" or "we" refers to the owner and promoter of the website at the URL www.bloomtrigger.com, www.bloomtrigger.co.uk and related URLs (the "=website" or "site" site).

Bloomtrigger CIC is a limited liability Community Interest Company registered in England and Wales under company number 6885623 and with registered office at Yew Tree Farm, Bexton Lane, Knutsford, Cheshire, WA169BH, United Kingdom. The terms "you" and "user" refer to the registered user or viewer of our website. Access to the website is permitted on a temporary basis and we reserve the right to withdraw the site or suspend the service or any content contained upon site at any time without notice.  We will not be liable if for any reason the site is unavailable at any time or for any period.

 
Purchasing

When you purchase goods (for example ‘blooms’) on this website you agree that you wish to receive the goods ordered and pay Bloomtrigger the purchase price immediately.

You are fully aware that by purchasing ‘blooms’ you are helping to protect rainforest and support the work undertaken by local forestry commissions.  A ‘bloom’ only has value as a virtual currency and represents a symbolic value of protected rainforest. You are NOT buying any form of tangible asset, such as land titles and have no rights of ownership over the area of rainforest being protected. You have no rights of ownership to any carbon value or forestry credits generated from the forest projects Bloomtrigger helps to protect. Any reference to carbon on the website is solely for educational purposes. It is agreed that as the true guardians of the forest the local forestry communities should be the primary beneficiaries from any additional value generated from the protected forest areas. Through the purchase of ‘blooms’ and other goods you are supporting Bloomtrigger and our forest conservation partners in our aim for perpetual forest preservation and we are committing to a 40 year model as a minimum.

We will act to ensure Bloomtrigger selects forestry projects carefully to maximize the effectiveness and long-term impact of our investment in rainforest protection. However we cannot be held responsible for any losses or failures that are beyond our reasonable level of control, such as natural disasters or due to excessive human interference.

Becoming a part of 'the bloomtrigger Corporation' and purchasing blooms

It is important to make clear that due to the nature of 'the bloomtrigger project' not all businesses and organisations will suitable or accepted due the organisations exposure on the website to primary school children under 12 years of age. Businesses related to gambling, alcohol or tobacco products are an obvious example of organisations that are not permitted to promote their brands to children by UK law. Therefore any business that does not meet the criteria to advertise to children under UK law is not be welcome to become a part of 'the bloomtrigger Corporation'. As a business looking to purchase blooms it is your responsibility to check with the Advertising Standards Authority to make sure you are not in breach of any laws. Should you subsequently be rejected from the bloomtrigger Corporation on these terms then Bloomtrigger will not provide any refund.

 
Cancellation and refund policy

Please note that as a CIC Community Interest Company, Bloomtrigger will not cancel or refund any purchase of ‘blooms’ other than payments taken owing to an error. You agree that from the moment the 'blooms' have been supplied to your profile the performance of the service by Bloomtrigger will begin. You agree to the service starting before the end of the usual cancellation period of seven working days, therefore your cancellation rights will end when performance of the service starts. Bloomtrigger reserves the right to reject or remove any individual or organisation from the website and will do so at our own discretion. If you are removed or rejected from the website Bloomtrigger will not provide any refunds, neither are we obligated to offer any explanation.

 
Limitation of liability

Nothing in these Terms of Use shall operate to exclude or limit our liability for (i) death or personal injury causes by our negligence; (ii) for our fraud; or (iii) for any other liability which cannot be excluded or limited under applicable law.

Subject to the preceding paragraph, Bloomtrigger will not be liable for any direct, indirect or consequential damages including but not limited to loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure  (even if advised of the possibility of such damages) resulting from, or in connection with, your use of this website.  Further Bloomtrigger will not be held responsible for any delay or failure to comply with our obligations under these Terms of Use if the delay or failure arises from any cause that is beyond Bloomtrigger’s reasonable control.

To the extent permitted by applicable law, all material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy or reliability or that it will be free from any defects (including without limitation) viruses or other harmful elements and we hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statue, common law or the law of equity; and any liability for any loss or damaged incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any website linked to it and any materials posted on it, whether caused by tort, breach of contract or otherwise.
